Harassment or sexual violence?
Maybe it would have ended there if those images hadn’t gone viral, triggering comments in favor, against, it is a harassment, it is not a harassment, he was surrounded by fans (so if he was looking for it?), In other times the singer would have called the groupie in the dressing room and no one would have anything to say, and so on indefinitely. Or maybe not. Because what happened to Blanco, in a square that contained 19,900 people, plus another thirty thousand around, became the starting point for asking a question and trying to find the answer. Was it harassment?
A crime punishable from 6 to 12 years
“No, it was sexual violence,” says the lawyer Giulia Bongiorno, Northern League senator, founder together with Michelle Hunziker of “Double defense”, the non-profit organization committed against discrimination, abuse and violence against women. Criminal Code in hand, article 609 bis, explains: “Sexual violence consists of any act which resolves itself into even fleeting bodily contact between passive and active subject endangers the freedom of self-determination”. In the case: groping erogenous zones without the consent of the other – man or woman – can integrate the crime of sexual violence, with a sentence of 6 to 12 years of imprisonment. “The key word is consent,” the lawyer goes on. “During his performance Blanco was not in a position to show it.”
It is not a “trick”
Much of the discussion on social media has instead focused on the word “harassment” – in reverse, what would have happened? – which Giulia Bongiorno, however, excludes. “Sexual harassment occurs in the case of vulgar expressions of a sexual nature: invasive and persistent courtship acts other than sexual abuse “.
